Understanding how attorneys charge for legal services is essential. This guide explains the three most common billing structures we use at Bianchi Law. These include flat fee agreements, hourly rate agreements, and contingent fee agreements.
Flat Fee Agreements (Most Common for Criminal Defense)
A flat fee is a predetermined minimum amount charged to handle your criminal case. Flat fees are widely used for DUI, misdemeanors, many felonies, probation violations and traffic offenses.
At Bianchi Law, flat fee minimums often encompass the total fee. However, while minimum flat fees cover most standard work, additional fees may be charged if the case requires above normal time or effort. Our clients are informed of this before signing a fee agreement, ensuring full transparency.
Hourly Rate Agreements
Under an hourly rate structure, the attorney charges a set fee for each hour of work. Hourly billing is used when the scope is unpredictable, such as civil litigation, divorces and family law disputes. You pay for the actual time spent, with detailed billing provided.
Contingency Fee Agreements
A contingency fee means the attorney is paid only if you win your case or recover money. Contingent fee agreements are primarily used in personal injury situations. Contingency fees are not allowed in criminal cases under Nebraska ethics rules (i.e., contingency arrangements cannot be used for DUI, domestic assault, drug or any other misdemeanor or felony charges).
If a criminal lawyer offers a contingency fee to represent you in your criminal matter, walk away immediately! It is unethical.
