Sex Crimes

It often begins with a knock at your door. Two plain clothed officers want to talk to you about…what happened the other night or those photos you or, God forbid, your teenager sent or even, whether you own or use a computer in your home. What may have started as some dirty, little fun has morphed into a nightmare. It could be based solely on somebody else’s word against you. You are in a ****storm. Now what do you do? Sex crimes used to be lumped into 3 categories: sexual assaults, sexual crimes of children (statutory rape, etc.) and prostitution. But technology has changed all that.

Modern Sex Crimes

Nowadays, you can commit serious felony crimes by yourself, in the comfort and privacy of your own home. It is no secret that pornography has exploded on the web. The internet, cell phones and the use or presence of video technology everywhere can land almost anybody – children included – in hot water with the law. Our society has a number of hard rules to criminalize people’s natural urges when those urges apparently cross the line. And we haven’t even talked about the effects of a conviction. Obviously, imprisonment in an issue. But what about those situations where you are not imprisoned (odd as it may sound, we have had several clients convicted of felony sex offenses who did not go to jail) or what happens to you when released from prison.

Sex Crimes Repercussions

Every person convicted of a sex offense must register as a sexual offender with the State Patrol and local Sheriff here in Nebraska. While sex offender registration serves a legitimate need, it has a devastating impact to the one who is required to register. The public is made aware of your status as a registered sex offender, where you live and the nature of your conviction. So, while other convictions certainly can impact an individual’s record going forward, the impact of a sex crime conviction guarantees it.

Here’s what to do:

  • Zip Your Lips

    KEEP YOUR MOUTH SHUT (and stay off the phone). There is not an easier way for law enforcement to prove its case than to have the accused admit to the crime. And cops are skilled at securing these admissions. Oftentimes, people who think they are doing the right thing by telling the truth are in fact doing nothing more than handing the cops the nails to be used for their crucifixion. You have a right to remain silent, so use it for a change. And this includes staying off phones. Phone calls can and often are recorded in Nebraska by private parties and law enforcement as well. And talking to the alleged victim can even get charges added to your case (eg, witness tampering, obstructing justice, etc.) Don’t talk to anybody about your situation except an attorney. 

  • Plan Accordingly

    GET MONEY. You will need to fund an attorney, a bail, and other litigation costs. In fact, some accused sex offenders, as one might imagine, are not even allowed bail. So, use whatever resources you have to secure as much money as you can (but keep in mind Rule #1, above).

    GET TO A QUALIFIED ATTORNEY RIGHT AWAY. This is one of those Critical times in life where you simply have to make an executive decision to do something drastic. You have to hire an attorney immediately and use all resources to get that done. Sex crimes are situations that often require immediate expert legal attention and are situations where frequently it is best to get out in front of the situation to acquire the best result. You are neither an expert nor a lawyer . Don’t pretend to be either one here.
