Perhaps no area has changed in the criminal law in the last 20 years more than the laws involving drugs and alcohol crimes, specifically, marijuana. Possession of marijuana remains illegal in the state of Nebraska and at the federal level as well. Many people naively think that the crimes involving marijuana are low on the totem pole of crimes and some think they are (or shouldn’t be) crimes at all. But even the passage of a marijuana joint from one person to another constitutes a felony under Nebraska law. Worse yet, Nebraska’s Supreme Court has all but certified a law enforcement officer’s search of you and your surroundings (think car) if an odor of marijuana is present. And we can all agree that this can lead to all kinds of other problems.
