Domestic Violence

It can happen to anybody. The stress of this world and our society is not lost on relationships. Money problems, alcohol or drug abuse, heck, even frustration over a ball game can lead to domestic violence. Domestic violence cases are serious business. Our society has evolved to the point that it no longer turns a blind eye to it.  This isn’t like the old days when officers would often show up and simply separate the two individuals. Nowadays, somebody is nearly always going to get arrested. That’s the law now. And most local jurisdictions immediately set a high bond on these charges, even before the accused has gone to court or even talked to an attorney.

And there are other consequences as well. Most people convicted of domestic violence are prohibited from having a firearm; in fact, if after a conviction, an individual possesses a firearm, it is a serious felony with mandatory imprisonment in Nebraska. Domestic-related offenses also take on greater penalties if committed a second time even if against a different victim. And we haven’t even talked about background checks . If you’re looking to be licensed in a certain area or apply for a certain job and have a conviction for this on your record, forget it.

So the storm has hit you. What are you going to do about it?

1. Keep Calm

Calm down! Nearly everyone charged with a domestic violence charge gets arrested. Getting overly excited or emotional – whether it be over the incident or the arrest – will only make the situation worse. Plus, it is almost certain the Court will order you not to have any contact with the alleged victim, anyway. So, practice by calming down and keeping your mouth shut. You have to get through this storm, not necessarily fight it, at least not right away.

2. Get prepared, getting out of jail isn’t free

Get money! These cases typically carry mandatory high bonds, so focus your immediate efforts on getting funds to securing counsel and money for bond.

3. Lawyer Up!

This nightmare that you or your loved one is going through may be resolved with sound legal representation. So, call me. I can help.
